TERMS OF USE

Effective May 21st, 2026

General Terms

Welcome to Rachel’s Hair Salon ("Salon," "we," "our," or "us"). By scheduling an appointment, entering our premises, or receiving any service, you ("Guest," "Client," or "you") agree to be bound by these Terms and Conditions ("Agreement"). This Agreement is governed by the laws of the State of Arizona.

Rachel's Hair Salon is a licensed cosmetology establishment operating in compliance with the Arizona State Board of Cosmetology regulations (ARS Title 32, Chapter 5). All of our stylists are individually licensed and insured professionals.

If you DO NOT AGREE to these terms, please DO NOT BOOK an appointment or use our services. Your continued patronage constitutes acceptance of this Agreement and any future modifications.

II. Booking & Scheduling

All appointments must be booked through our authorized scheduling system — online, by phone, or in person. Walk-in availability is subject to stylist schedules and cannot be guaranteed.

When booking, you agree to provide accurate contact information (phone and email) so we may send appointment confirmations and reminders. Appointment confirmations are a courtesy; the absence of a reminder does not waive our cancellation policies.

We reserve the right to refuse service to any individual at our discretion, consistent with Arizona civil rights laws (ARS § 41-1442).

III. Cancellation & No-Show Policy

A Mutual Respect Agreement

Our stylists dedicate time, preparation, and creative energy to your appointment. This policy ensures fairness for both our team and our guests.

24-Hour Notice: We require at least 24 hours' notice for cancellations or rescheduling. Cancellations made with less than 24 hours' notice will incur a fee equal to 50% of the booked service price.

No-Show Fee: Guests who fail to arrive without any notice ("no-show") will be charged 100% of the reserved service price. This fee compensates for the reserved time that could not be offered to other guests.

Repeated No-Shows: Two or more no-shows within a 6-month period may result in a required deposit for future bookings or suspension of booking privileges.

In accordance with Arizona consumer protection standards, all fees will be clearly communicated at the time of booking and charged to the payment method on file.

IV. Arrival & Grace Period

We kindly ask that you arrive 5–10 minutes before your scheduled appointment to allow time for check-in, consultation, and a complimentary beverage.

Grace Period Timeline

On Time Grace Forfeit

0 min 15 min 15+ min

Arrivals within 15 minutes of your scheduled time are welcome. After 15 minutes, your appointment may be shortened or rescheduled at our discretion, and a cancellation fee may apply.

Grace Period: A 15-minute grace period is provided. If you arrive more than 15 minutes past your appointment time, your service may be shortened to accommodate the remaining time, rescheduled, or considered a no-show at the stylist's discretion.

If your service must be shortened due to late arrival, you will be charged the full original price, as the complete time slot was reserved for you.

V. Wellness & Hydration

☀️ Arizona Heat Advisory

Arizona temperatures can exceed 110°F. For your safety and comfort, we strongly recommend hydrating before your appointment. Complimentary water is always available in our salon.

If you are feeling unwell, dehydrated, or experiencing symptoms of heat exhaustion upon arrival, please inform our front desk. We will gladly reschedule your appointment at no charge — your health is our priority.

We maintain a climate-controlled environment and encourage guests to take their time after extended heat exposure before beginning any chemical or thermal service.

VI. Chemical & Specialized Services

Certain services — including but not limited to hair coloring, bleaching, keratin treatments, Brazilian blowouts, Tanino treatments, perms, and chemical relaxers — involve the use of professional-grade chemicals that carry inherent risks.

Patch Test: For first-time guests receiving color or chemical services, we may require a patch test performed 24–48 hours prior to your appointment. This is a safety measure to check for allergic reactions, consistent with industry’s best practices and Arizona Board of Cosmetology guidelines.

Informed Consent: Prior to any chemical service, you might be asked to sign a separate Chemical Service Consent Form that discloses specific risks, including but not limited to; allergic reactions, hair damage or breakage, scalp irritation, and results that may differ from expectations.

Previous Chemical History: You are required to disclose any chemical treatments performed at other salons or at home within the past 12 months. Failure to disclose prior chemical history may release the Salon from liability for adverse outcomes.

Right to Refuse: Our stylists reserve the right to refuse or modify a chemical service if they determine, in their professional judgment, that proceeding would compromise the health of your hair or scalp.

VII. Liability & Waivers

To the fullest extent permitted by Arizona law, Rachel’s Hair Salon, its owners, employees, and contractors shall not be liable for any indirect, incidental, or consequential damage arising from services rendered, except in cases of gross negligence or willful misconduct.

Assumption of Risk: By receiving services, you acknowledge that cosmetology procedures inherently involve certain risks. You assume responsibility for disclosing all relevant medical conditions, allergies, medications, and prior treatments that may affect service outcomes.

Personal Property: The Salon is not responsible for lost, stolen, or damaged personal property left on premises. We recommend leaving valuables at home or secured in your vehicle.

Results Disclaimer: While our stylists exercise the highest level of professional care, we cannot guarantee specific outcomes. Results may vary based on individual hair type, condition, chemical history, and other factors.

Any claims against the Salon must be brought within 7 days of the service date. We are committed to resolving concerns promptly and fairly through our internal satisfaction process.

VIII. Payment & Pricing

Full payment is due at the time of service unless otherwise arranged. We accept cash, major credit cards, and approved digital payment methods.

Pricing Transparency: Service prices are listed on our website and available at the front desk. Pricing may vary based on hair length, density, and complexity. Because of this variability, we highly recommend checking your final price either during your consultation or before the service begins. This way, you can have a clear understanding of the costs associated with your specific haircare needs.

Gratuity: Gratuities are appreciated but never expected. Tips are accepted in cash or via card at checkout. Per Arizona law, gratuities belong solely to the service provider.

Sales Tax: Arizona Transaction Privilege Tax (TPT) will be applied to retail product purchases. Personal services may also be subject to applicable local taxes per your municipality.

Refund Policy: No refunds for professional standard services.

  • No automatic right to a refund: Once a service is completed to the professional standards agreed upon, the salon is under no legal obligation to refund your money simply because you are unhappy with the result.

  • Binding terms: No refunds for all professional service charges at Rachel’s Hair Salon. If you are unsatisfied with your services, please contact us within 7 days from the service date to discuss a complimentary correction service.

  • Product returns: Product returns are accepted within 14 days in unused condition with original receipt.

IX. Gift Card Policy

General Terms: Gift cards can be purchased at any time and are valid for services at our salon. Gift cards are non-transferable and are for personal use only.

Non-Refundable: All gift card purchases are final and non-refundable. No refunds, exchanges, or credits will be issued for any reason, including but not limited to: change mind, unused balance, or dissatisfaction with services.

No Expiration Date: Gift cards do not expire and can be used at any time. There is no time limit on when the gift card must be redeemed.

No Cash Value: Gift cards have no cash value and cannot be redeemed for cash or used to obtain cash refunds. The gift card balance cannot be transferred to another form of payment or account.

Balance Inquiries: Customers can check their gift card balance by contacting our salon directly. We are not responsible for lost, stolen, or damaged gift cards.

Terms of Service: Gift cards must be used in accordance with all applicable salon policies and terms of service. The salon reserves the right to refuse service.

X. Kids Policy

In our salon, we prioritize the safety and comfort of all our clients. We kindly ask that you keep children away from our products, as many contain chemicals that may not be safe for young ones to touch or smell. To ensure a serene and enjoyable experience for everyone, we request that children refrain from running around or disturbing other clients during their visit. Your cooperation helps us maintain a peaceful environment, allowing our staff to provide the best service possible. Thanks for your understanding and supporting our efforts to create a safe and relaxing environment for all

XI. Arizona Consumer Rights

As an Arizona consumer, you are protected under the Arizona Consumer Fraud Act (ARS § 44-1521 et seq.), which prohibits deceptive or unfair business practices. We are committed to full compliance with this statute.

Right to Information: You have the right to receive clear information about the services you are purchasing, including pricing, expected outcomes, and any associated risks, before the service begins.

Complaint Resolution: If you believe your consumer rights have been violated, you may file a complaint with the Arizona Attorney General's Office, Consumer Protection Division, or the Arizona State Board of Cosmetology.

Dispute Resolution: In accordance with ARS § 12-1501 et seq., any dispute arising from this Agreement that cannot be resolved informally shall be submitted to mediation before a mutually agreed-upon mediator in Maricopa County, Arizona, prior to initiating litigation.

Governing Law: This Agreement is governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles.

XII. Privacy & Data

We collect and store personal information (name, contact details, service history, and payment information) solely for the purpose of providing and improving our services.

Your data will not be sold to third parties. We may share information only with trusted service providers (e.g., payment processors, booking systems) necessary to operate our business, or when required by Arizona or federal law.

Guests may request access to, correction of, or deletion of their personal data by contacting us directly. We will respond to such requests within 30 business days.

Appointment photographs may be taken for our portfolio with your explicit verbal or written consent. You may revoke this consent at any time.

XIII. Modifications to These Terms

Arid Sanctuary reserves the right to update or modify these Terms and Conditions at any time. Material changes will be communicated via our website and/or email notification at least 14 days prior to taking effect.

Continued use of our services following any modifications constitutes acceptance of the revised terms. We encourage guests to review this Agreement periodically.

If any provision of this Agreement is found to be unenforceable or invalid under Arizona law, the remaining provisions shall continue in full force and effect.

If you have any questions about these Terms and Conditions, please contact us at your next visit or reach out Support@rachelhairsalonmesa.com via email. We believe in radical transparency — and we're always happy to explain.
